Terms of Purchase and Sale in the Elstila.lt Online Store

1.    Definitions

1.1.    Seller - UAB "Elstila", legal entity code 134311048, VAT payer's code LT343110412, registered office address Jonavos g. 62A, LT-44192 Kaunas, correspondence address Jonavos g. 62A, LT-44192 Kaunas. Elstila.lt is also understood as the Seller in these Rules regarding the goods it sells.
1.2.    Buyer - 1) a capable natural person, i.e., a person of legal age whose legal capacity is not restricted by a court order; 2) a minor from fourteen to eighteen years of age who has the consent of parents or guardians, except when emancipated; 3) a legal entity.
1.3.    Parties - Buyer and Seller together.
1.4.    Personal data - any information about a natural person whose identity is established or can be identified (data subject); a natural person whose identity can be established is a person whose identity can be directly or indirectly identified, primarily by an identifier, such as name and surname, personal identification number, location data, and internet identifier, or by one or more physical, physiological, genetic, mental, economic, cultural, or social identity markers of that natural person.
1.5.    Rules - these "Terms of Purchase and Sale on Elstila.lt", which apply to each Buyer's purchase on Elstila.lt and to each Purchase and Sale Agreement concluded between the Buyer and the Seller.
1.6.    Account - the result of the Buyer's registration on www.elstila.lt based on the Rules, which creates his personal data and maintains the personal Buyer's account with order history.
1.7.    Privacy Policy - a document approved by Elstila.lt, which sets out the basic rules for the collection, storage, processing, and retention of personal data using Elstila.lt. Elstila.lt's privacy policy does not include the processing of personal data when such data is processed by the Seller. The processing of personal data by the Seller is carried out in accordance with the Seller's established procedure. Before purchasing goods and entering into this agreement with the Seller, the Buyer should carefully review the Seller's applicable personal data processing policy.
1.8.    Stores - stores belonging to Elstila.lt located at the following addresses: Jonavos g. 62A Kaunas, Šiaurės pr. 11 Klaipėda, and Geologų g. 7a Vilnius. Other store addresses are constantly publicly available at www.elstila.lt
1.9.    Contract - a Purchase and Sale Agreement concluded between the Buyer and the Seller, which is considered concluded from the Order Confirmation, i.e., from the moment of placing the order. It is considered that the terms of each Purchase and Sale Agreement concluded between the Buyer and the Seller are identical to the conditions of these Rules, and such Agreements are always executed by the parties in accordance with these Rules.
1.10.    Order - an order for Goods in which the Buyer specifies the Goods he wishes to purchase from the Seller, specified in the same order.

2.    General Provisions

2.1.    The Buyer confirms the Rules by familiarizing himself with them and checking the box next to the statement "I have read and agree to the terms of purchase and sale and privacy policy, and I agree to them." The Rules thus confirmed are a legally binding document for the Parties, establishing the rights and obligations of the Buyer and the Seller, the conditions for the acquisition and payment of goods, the procedure for the delivery and return of goods, the liability of the parties, and other conditions related to the purchase and sale of goods on Elstila.lt.
2.2.    The Buyer, by creating an account on Elstila.lt, confirms the Rules during the first registration. By confirming the Rules during the first registration (account creation), the Rules apply to all Buyer's purchases made on Elstila.lt and to all purchase and sale agreements concluded with the Seller before the updated Rules are published. After updating the Rules, they apply in this order from their publication on www.elstila.lt
2.3.    Buying from Elstila.lt is only possible for Buyers as defined in paragraph 1.2 of the Rules. By confirming the Rules and familiarizing themselves with the Privacy Policy (paragraph 2.4 of the Rules) and the Terms of Use of Elstila.lt, the Buyer confirms that he has the right to purchase goods from Elstila.lt.
2.4.    In case of necessity or under circumstances provided for by the laws of the Republic of Lithuania, Elstila.lt has the right to change, amend, or supplement the Rules. Buyers will be informed about this by logging into their Account or by purchasing goods from the selected Seller after the entry into force of the new version of the Rules.
2.5.    The Buyer must familiarize himself with the Privacy Policy approved and publicly announced by Elstila.lt. The Buyer's personal data will also be transferred to the Seller from whom the Buyer purchases the Goods, and such Personal data will be processed by the Seller, as specified in the order, in accordance with the security obligations for the security of personal data assumed between Elstila.lt and the Seller.
2.6.    If the Seller is required or obligated to provide the Buyer with information or documents by electronic mail, in all cases, the provision of the active and Buyer's electronic mail address belongs to the responsibility of the Buyer himself.

3.    Ordering of Goods, Establishment of Legal Relations of Purchase and Sale

3.1.    The Buyer can order goods from Elstila.lt (elstila.eu, elstila.com) by choosing one of the following methods:

3.1.1.    by registering online at Elstila.lt (entering their registration name and password);
3.1.2.    online without registering at Elstila.lt;
3.1.3.    by phone or email: parduotuve@elstila.lt;
3.1.4.    in physical Stores.

3.2.    When ordering goods as specified in paragraph 3.1.1 of the Rules, the Buyer must provide in the relevant fields of information provided in the Elstila.lt system the personal data necessary for the proper execution of the order, which are processed by Elstila.lt in the manner provided for in the Privacy Policy.
3.3.    Orders for goods submitted by email, telephone, or in stores are processed in accordance with the Rules and are subject to the provisions of the Privacy Policy. By placing an order, the Buyer agrees to the Rules and their application.
3.4.    When the Buyer, having selected the item for purchase and added it to the shopping cart, completes all the steps of the order, the final one being the selection and confirmation of the payment method, it is considered that legal relations of purchase and sale have been established between the Seller and the Buyer, and a purchase and sale agreement has been concluded. The Buyer is informed of the order confirmation by providing a notification to the Buyer's designated email address.
3.5.    Each Buyer's order is stored in the Seller's database in accordance with the provisions of their privacy policy.

4.    Buyer's Rights

4.1.    The Buyer has the right to purchase goods and order services from Elstila.lt in accordance with these Rules.
4.2.    The Buyer has the right to cancel an order in accordance with these Rules.
4.3.    The Buyer has the right to cancel the Agreement in accordance with these Rules.
4.4.    The Buyer has the right to exchange or return purchased goods in accordance with these Rules.
4.5.    The Buyer has other rights established in these Rules, the Privacy Policy, the Terms of Use of Elstila.lt, and the laws of the Republic of Lithuania.

5.    Buyer's Obligations

5.1.    The Buyer, when using Elstila.lt, must fulfill their obligations, comply with these Rules, the Privacy Policy, the Terms of Use of Elstila.lt, other conditions clearly specified by Elstila.lt, and not violate the laws of the Republic of Lithuania.
5.2.    The Buyer must pay for the ordered goods or services and accept them in accordance with these Rules. If choosing to collect the goods from the Store, the Buyer must collect them from the selected Store within the time limits specified in the Rules.

6.    Seller's Rights

6.1.    The Seller has the right, without prior notice to the Buyer, to cancel their order if the Buyer, choosing the payment methods specified in paragraphs 8.2.1 or 8.2.2 of the Rules, fails to pay for the goods within 3 (three) working days.
6.2.    When the Buyer chooses the payment method specified in paragraph 8.2.3 of the Rules, the Seller, in case of uncertainties regarding the information provided in the order, has the right to contact the Buyer using the contact details provided in the order. The delivery time of the goods starts in this case from the day of contacting the Buyer. The Buyer's order may be canceled without prior notice if: i) the Seller fails to contact the Buyer within 2 (two) working days after the order is placed, or ii) the Buyer does not provide the requested information to the Seller within the time specified by the Seller, or iii) the Buyer does not provide the Seller with consent for verification of their personal data.
6.3.    The Seller has the right at their discretion, without the separate consent of the Buyer, to divide the purchase of selected items (items of a specific seller) into separate orders, unless the Buyer, before confirming the orders, requests to purchase the items in the cart by submitting a single combined order. In the event of such division, the price of additional services (e.g., delivery, installation, etc.) attributable to a specific order is divided accordingly among the separate orders and is calculated separately for each order, so it may differ from the price of services indicated in the description of a specific item. The Seller has other rights established in these Rules, the Privacy Policy, other Elstila.lt documents, and the laws of the Republic of Lithuania.

7.    Seller's Obligations

7.1.    The Seller undertakes to fulfill the Buyer's orders in accordance with these Rules and to communicate with the Buyer through the means specified on the Elstila.lt website. 
7.2.    The Seller undertakes to provide the Buyer with information clearly and understandably in the Elstila.lt system, as established in Article 6.228-7 of the Civil Code of the Republic of Lithuania.
7.3.    The Seller and Elstila.lt undertake to respect the Buyer's privacy, to process the Buyer's Personal data only in accordance with the Rules, the Privacy Policy, the Terms of Use of Elstila.lt, and the laws of the Republic of Lithuania and the European Union.
7.4.    Elstila.lt undertakes to inform the Buyer, before the submission of an order, about the suspension or termination of significant functions of Elstila.lt, as well as about the changes specified in paragraphs 6.2 - 6.3 of the Rules. Providing information in the Elstila.lt Account or on the Elstila.lt e-commerce website is considered appropriate notification. When the Buyer's order is already accepted for execution, the Buyer is informed about the suspension or termination of significant functions of Elstila.lt regarding this order by one of the contact details provided by the Buyer (telephone, SMS message, or email).
7.5.    Under the conditions specified in the Rules, the Seller undertakes to provide the Buyer with the ordered goods and accept the goods returned by the Buyer.
7.6.    In the event that, due to significant circumstances, the Seller cannot deliver the ordered goods to the Buyer, the Seller may offer the Buyer a similar or analogous item and inform the Buyer thereof using one of the contact details provided by the Buyer (telephone, SMS message, or email). If the Buyer does not agree to replace the item with a similar or analogous item, the Seller, who cannot deliver the item selected by the Buyer, undertakes to refund the Buyer the amount paid within 14 (fourteen) working days if advance payment was made, and in all cases to cancel the order.
7.7.    In the event that within 3 (three) working days from the submission of the proposal, the Buyer confirms by one of the contacts specified on the Elstila.lt e-commerce website that they agree to replace the item with another item sold by a different Seller, the original Seller undertakes to refund the Buyer the amount paid for the item that the original Seller cannot deliver, and compensate for the price difference. 
7.8.    If the Seller disagrees with the Buyer's demands, the Seller must provide the Buyer with a detailed, reasoned written response no later than 14 (fourteen) calendar days from the date of receipt of the Buyer's request through Elstila.lt, unless otherwise provided by the laws of the Republic of Lithuania and the European Union.
7.9.    The Seller undertakes to fulfill other obligations imposed on the Seller by these Rules and the laws of the Republic of Lithuania.

8.    Prices of Goods, Payment Terms and Conditions

8.1.    The prices of goods on Elstila.lt are indicated in euros, including the VAT rate and other taxes applicable under the legislation at the time.
8.2.    The Buyer can pay for the ordered goods by one of the following methods (the choice may be limited, so the final list of payment methods applicable to a specific order is indicated next to the respective order):

8.2.1.    using online banking;
8.2.2.    by bank transfer;
8.2.3.    in cash or by bank card upon collection of goods (only in Stores);
8.2.4.    by other methods specified on the Elstila.lt website

8.3.    When the Seller receives payment for the goods or receives confirmation of financing for the purchase (when such payment method is applicable and if the Buyer chooses the payment method specified in paragraphs 8.2.4 - 8.2.5 of the Rules), the order of goods is confirmed.

8.4.    By confirming the Rules, the Buyer agrees that the purchase documents of goods - VAT invoices, which also serve as warranty documents for the goods, may be provided to the Buyer physically together with the goods or electronically to the email address provided by the Buyer in the registration form immediately after the order is fulfilled. VAT invoices contain the Seller's details, selected items, their quantity, discounts granted, final price of the goods, including all taxes, and other mandatory data to be provided under the accounting laws.
8.5.    The price of goods may change only in exceptional cases, when the price of goods changes due to technical errors in information systems, correction of obvious (clerical) errors, or other objective essential reasons beyond the control of the Seller (subject to evidence supporting these reasons). If in such cases the Buyer does not agree to purchase the item at the new price, the Buyer may cancel the order by informing the Seller within 2 (two) working days through the contacts provided on the Elstila.lt e-commerce website. Upon cancellation of the order in this paragraph, the Seller undertakes to refund the Buyer all amounts paid by the Buyer for such canceled order.

9.    Delivery of Goods

9.1.    When ordering goods, the Buyer may choose one of the delivery methods specified in the specific offer of the Seller.
9.2.    If the Buyer chooses the home delivery service during the order:

9.2.1.    The Buyer undertakes to provide the exact delivery location for the goods.
9.2.2.    The Buyer undertakes to accept the goods personally. When accepting the goods, it is necessary to present a valid personal identification document (identity card, passport, or a new model driver's license). If the Buyer does not accept the goods personally even though the goods have been delivered to the address specified by the Buyer, the Seller has the right to transfer the goods to another person at the address specified by the Buyer, and the Buyer has no right to make any claims to the Seller regarding the improper delivery of goods to another person.
9.2.3.    The goods are delivered by the Seller or its authorized representative.

9.3.    The Buyer may collect the goods free of charge at Elstila.lt Stores. If the Buyer chooses this method during the order submission:

9.3.1.    Only the person who placed the order or the person specified at the time of order submission may collect the goods.

9.4.    The delivery deadlines specified in the Product description are preliminary. The Seller delivers the goods to the Buyer according to the deadlines indicated in the order confirmation. The delivery deadlines do not apply in cases where the necessary goods are not available in the Seller's warehouse, and the Buyer is informed of the shortage of the goods ordered. By confirming these Rules, the Buyer agrees that in exceptional cases, the delivery of goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such cases, the Seller undertakes to immediately contact the Buyer and agree on the delivery terms and other conditions. If the Seller fails to deliver the goods within the deadline specified in the order and the Parties do not agree on an additional deadline for the delivery of goods, the Buyer may exercise the right provided for in paragraph 11.1 of the Rules - to refuse the purchase - sale contract of goods or services.
9.5.    The Seller is released from liability for the breach of delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to third parties unrelated and/or independent of the Seller, the fault of the Buyer, or due to circumstances belonging to the Buyer.
9.6.    During the delivery of goods to the Buyer, the Buyer must inspect the shipment and the condition of the item(s) together with the courier, or in the case of physical collection of goods at the Store - with Elstila.lt or its authorized representative, and sign the shipment transfer - acceptance document. When the Buyer signs the shipment transfer - acceptance document, it is considered that the goods have been transferred in a proper condition, without damages not attributable to manufacturing defects, and there are no discrepancies in the composition of the goods (which can be determined during external inspection of the goods). If the Buyer notices that the packaging of the delivered goods is damaged (crushed, wet, or otherwise externally damaged), the item(s) are damaged, and/or the item(s) are of improper composition, the Buyer must indicate this in the shipment transfer - acceptance document and, in the presence of the courier, or in the case of physical collection of goods at the Store - Elstila.lt or its representative, draw up a free-form act of damage/non-conformity of the shipment and/or item(s). If the Buyer fails to take these actions, the Seller is released from liability for damages to the goods, provided that such damages are not due to manufacturing defects and discrepancies in the composition of the goods can be determined during external inspection of the goods.
9.7.    The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are handed over to the Buyer.
9.8.    If, based on paragraphs 9.2 - 9.4 of the Rules, the Buyer fails to collect the goods within the specified period or fails to deliver them to the Buyer, and the Buyer has paid for the goods and their delivery, representatives contact the Buyer regarding another delivery time and/or method of the goods. If the Buyer still does not collect the goods or fails to deliver them, such goods are returned to the Seller, the order is canceled, and the Buyer is refunded the amount paid for the goods, minus bank charges applicable to the Seller for bank transfers made and the delivery fee, if applicable.
9.9.    If, based on paragraphs 9.2 - 9.4 of the Rules, the Buyer fails to collect the goods within the specified period or fails to deliver them to the Buyer, and the Buyer has not paid for the goods, such goods are returned to the Seller, and the order is canceled.

10.    Quality Warranty and Terms of Use

10.1.    The characteristics of each item sold by the Seller are specified in the description accompanying each item.
10.2.    The items offered for purchase by the Seller are of suitable quality. An item conforms to the contract of sale if:

10.2.1.    the item corresponds to the description provided by the Seller and has the same characteristics as the item presented by the Seller as an example or model when advertising that item on Elstila.lt;
10.2.2.    the item is suitable for the purposes for which items of that kind are normally used;
10.2.3.    the item meets the quality indicators typically associated with items of the same nature, and which the Buyer can reasonably expect based on the nature of the item and public statements made by the manufacturer, its representative, or seller, including advertising and labeling, regarding specific characteristics of the item.

10.3.    The Seller is not responsible if the items sold by Elstila.lt do not match their size, shape, color, or other parameters with real item sizes, shapes, colors, or other parameters due to the peculiarities of the Buyer's display or other technical reasons beyond the Seller's control. Item photos are for illustrative purposes only and are exemplary. The colors, inscriptions, parameters, dimensions, sizes, functions, and/or any other features of original products may appear differently than in reality due to their visual characteristics, so please refer to the item descriptions for the actual features. It is recommended that the Buyer read the item description.
10.4.    The Seller provides a certain period of validity for the quality warranty for different types of items, the specific term and other conditions of which are indicated in the descriptions of such items or together with the item's invoice, which corresponds to the warranty sheet.
10.5.    The quality warranty provided by the Seller does not restrict or limit consumer rights established by laws when purchasing a defective item or service.
10.6.    The Seller does not provide warranty maintenance services for items (except for simple checks of item operation that do not require special knowledge):

10.6.1.    if the service center(s) providing warranty service is located outside the Republic of Lithuania, the Seller arranges for the items to be sent to such center(s);
10.6.2.    if the service center(s) providing warranty service is located in the Republic of Lithuania, the Buyer is directed to such center(s).

10.7.    The warranty does not apply to information contained in data carriers. Expenses related to data loss or recovery are not covered.
10.8.    In cases where specific items are subject to a certain term of fitness for use established by laws, the Seller undertakes to sell such items to the Buyer in a way that provides the Buyer with a real opportunity to use such items until the end of the term of fitness for use.

11.    Right to withdraw from the purchase-sale agreement, procedure for returning and exchanging goods

11.1.    Right to withdraw from the purchase-sale agreement:

11.1.1.    The Buyer, without specifying a reason, has the right to withdraw from the purchase-sale agreement within 14 (fourteen) days by notifying the Seller through Elstila.lt. The Buyer cannot exercise this right when concluding one of the agreements listed in Article 6.22810(2) of the Civil Code of the Republic of Lithuania.
11.1.2.    The Buyer notifies Elstila.lt of the withdrawal from the purchase-sale agreement by filling out a sample withdrawal form or by submitting a clear statement expressing the decision to withdraw from the agreement. The notification of withdrawal from the agreement is sent by email to elstila@elstila.lt.
11.1.3.    The 14 (fourteen) day period provided for exercising the right to withdraw from the purchase-sale agreement is calculated as follows: a. when the purchase-sale agreement is concluded - from the day the Buyer or the person specified by him, excluding the carrier, receives the ordered goods; b. if the goods are delivered in separate batches or parts - from the day the Buyer or the person specified by him, excluding the carrier, receives the last batch or part; d. if an agreement is concluded for the regular delivery of goods over a specified period - from the day the Buyer or the person specified by him, excluding the carrier, receives the first item.
11.1.4.    If the Buyer withdraws from the purchase-sale agreement before the goods have been delivered to him, the Buyer must inform about it through the contacts indicated on the Elstila.lt website. The Buyer's withdrawal is formalized as a rejection of the order, and the Seller is informed accordingly.
11.1.5.    If the Buyer withdraws from the purchase-sale agreement after the goods have already been delivered or he has received them, the provisions specified in point 11.6 of the Rules shall apply.

11.2.    Additional money-back guarantee for the Seller

11.2.1.    After 14 (fourteen), but not later than 30 (thirty) days from the date of delivery or receipt of the goods, the Buyer has the right to avail himself of the additional money-back guarantee provided by the Seller if all returned goods have authentic labels, protective bags, and original packaging, the single-use product packaging is not damaged, i.e., the goods have not lost the appearance in which they were sold. The Buyer participating in separate loyalty programs providing more favorable conditions for the additional money-back guarantee will be subject to the regulations of such loyalty programs. The Seller has the right to specify the additional money-back guarantee period for a specific product in the description of the product on Elstila.lt. In all cases, the additional money-back guarantee (if it is applied by the Seller for a specific product) shall be implemented mutatis mutandis in accordance with the provisions of points 11.2.2-11.2.7 of the Rules.
11.2.2.    To indicate the intention to use this guarantee (if applicable), the Buyer must notify within the period specified by the Seller for such guarantee, calculated from the day of delivery of the goods to the Buyer. The notification is sent by email to elstila@elstila.lt, and it must specify the returned goods.
11.2.3.    If the notification is made within 14 (fourteen) calendar days from the day of delivery of the goods to the Buyer, the provisions of point 11.1 of the Rules shall apply.
11.2.4.    If the notification is made after the 14 (fourteen) calendar day period but no later than within the additional money-back guarantee validity period specified by the Seller from the day of delivery of the goods to the Buyer, the Buyer shall bear all expenses and risks related to the return of the goods. In any case, the goods must be returned to the Seller within the specified guarantee period, calculated from the day of delivery or receipt of the goods.
11.2.5.    The Buyer has the right to return the goods by sending them to the addresses specified on the Elstila.lt e-commerce website or by bringing them to the Elstila.lt Stores.
11.2.6.    The procedure for the return of goods and money is provided for in point 11.6 of the Rules.

11.3.    Rules for exchanging and returning goods of appropriate quality

11.3.1.    The Buyer has the right to exchange purchased goods for analogous goods of different dimensions, shape, color, model, or completeness within 14 (fourteen ) days from the day of delivery of the goods to the Buyer, notifying Elstila.lt about it by e-mail to elstila@elstila.lt. The Seller may refuse to exchange the goods if the goods are not suitable for exchange due to their specific properties or due to other circumstances provided for in the Law of the Republic of Lithuania on Legal Protection of Personal Data.
11.3.2.    The Buyer has the right to return the purchased goods of appropriate quality to the Seller within 14 (fourteen) days from the day of delivery of the goods to the Buyer, notifying Elstila.lt about it by e-mail to elstila@elstila.lt.
11.3.3.    The provisions of points 11.2.4-11.2.6 of the Rules shall apply to the return of goods under this paragraph mutatis mutandis.
11.3.4.    If the Buyer has the right to use the additional money-back guarantee, it is not possible to exchange the goods of appropriate quality.
11.3.5.    The right to exchange and return goods of appropriate quality does not apply in cases where the Buyer purchases goods that have been made according to the Buyer's individual instructions, have been manufactured for a specific Buyer, or are clearly personalized. In this case, the goods of appropriate quality can be exchanged or returned only if they do not conform to the contract.

11.4.    Rules for exchanging and returning non-food goods of inappropriate quality

11.4.1.    The Buyer has the right to exchange non-food goods of inappropriate quality for goods of appropriate quality or to return them to the Seller within the period of the additional money-back guarantee provided by the Seller, but not later than within 14 (fourteen) days from the day of delivery of the goods to the Buyer, by notifying Elstila.lt about it by e-mail to elstila@elstila.lt.
11.4.2.    If the Buyer has the right to use the additional money-back guarantee, the provisions of points 11.2.4-11.2.6 of the Rules shall apply to the return of goods under this paragraph mutatis mutandis.
11.4.3.    In the event of exchanging or returning non-food goods of inappropriate quality, the Buyer must provide proof of purchase of the goods (a cash register receipt, an invoice, or another document confirming the conclusion of the purchase-sale agreement).

11.5.    The consequences of withdrawal from the purchase-sale agreement or exchange or return of goods:

11.5.1.    The Buyer must return the goods to the Seller within 14 (fourteen) days from the day he informed the Seller about his decision to withdraw from the purchase-sale agreement, to exchange the goods, or to return them. The Buyer bears the direct costs of returning the goods, except in cases where the Seller agrees to cover these costs. The goods must be returned in their original packaging, and the Buyer must cover the costs associated with reducing the value of the goods if they have deteriorated during the period of use exceeding the time necessary to make sure that the goods conform to the contract, their nature, properties, and the characteristics of the goods.
11.5.2.    The Seller has the right to refuse to accept the goods returned by the Buyer if the Buyer has not followed the procedure for returning the goods set out in the Rules or has violated the terms and conditions of returning the goods.
11.5.3.    The Seller undertakes to return all sums paid by the Buyer no later than within 14 (fourteen) days from the day he received the Buyer's notification of withdrawal from the purchase-sale agreement, exchange, or return of goods.
11.5.4.    The Seller has the right not to return the sums paid by the Buyer until the Buyer returns the goods or provides proof that he has sent the goods back, depending on which event occurs first.
11.5.5.    The Seller returns the sums paid by the Buyer using the same payment method that the Buyer used for the original transaction unless the Buyer has explicitly agreed to another payment method, and provided that the Buyer does not incur any additional costs as a result.
11.5.6.    If the Buyer paid for the goods by bank transfer, the Seller returns the sums paid by the Buyer to the bank account from which the Buyer made the payment.
11.5.7.    If the Buyer paid for the goods using a credit or debit card, the sums paid by the Buyer are returned to the card with which the Buyer paid for the goods.
11.5.8.    The Seller has the right to deduct the direct costs associated with returning the goods from the sums paid by the Buyer (transportation, delivery, and other direct costs associated with the return of the goods) if the Buyer returns the goods after the expiry of the term specified in paragraph 11.1 or paragraph 11.3 of the Rules, except for the cases provided for in paragraph 11.4 of the Rules.
11.5.9.    If the goods returned by the Buyer do not meet the conditions specified in points 11.5.1 and 11.5.2 of the Rules, the Seller has the right to reduce the sums paid by the Buyer for the goods accordingly.
11.5.10.    If the Buyer used a discount code when purchasing the goods, the amount refunded to the Buyer does not include the discount code.
11.5.11.    The Seller has the right to refuse to exchange the goods or return the sums paid by the Buyer for the goods if the goods have been damaged or their appearance has deteriorated significantly during the period of use exceeding the time necessary to make sure that the goods conform to the contract, their nature, properties, and the characteristics of the goods.

11.6.    Refunds to the Buyer for returned goods:

11.6.1.    The Seller refunds the sums paid by the Buyer for the goods no later than within 14 (fourteen) calendar days from the date of receipt of the Buyer's notification of withdrawal from the purchase-sale agreement, exchange, or return of goods. The sums paid by the Buyer for the goods are returned to the Buyer only after the goods have been returned to the Seller, or the Buyer provides proof that he has sent the goods back, depending on which event occurs first.
11.6.2.    The Seller returns the sums paid by the Buyer for the goods using the same payment method that the Buyer used for the original transaction unless the Buyer has explicitly agreed to another payment method, and provided that the Buyer does not incur any additional costs as a result.

12.    Liability

12.1.    The Buyer is responsible for any illegal actions performed using Elstila.lt.
12.2.    The registered Buyer is responsible for the storage and/or transmission of their login data to third parties. If a third party uses the services provided by Elstila.lt, having logged in using the Buyer's login data, the Seller considers this person as the Buyer.
12.3.    The Seller is released from any liability in cases where losses arise because the Buyer, disregarding the Seller's recommendations and obligations, did not familiarize themselves with these Rules, Privacy Policy, terms of use of www.elstila.lt, even though such opportunity was provided to them.
12.4.    If the links provided by Elstila.lt lead to websites of other third parties, Elstila.lt does not guarantee that the information available by clicking on these links is correct, comprehensive, or accurate. Third parties are responsible for the content, accuracy, completeness, and accuracy of the information provided by them. Elstila.lt is not obliged to verify external information transmitted or stored, or to identify illegal actions.

13.    Marketing Measures Applied by Elstila.lt

13.1.    The Seller may initiate various promotions or games on Elstila.lt at their discretion.
13.2.    Elstila.lt has the right to unilaterally, without separate notice, change the terms of promotions or games, as well as to cancel them.

14.    Exchange of Information

14.1.    All communication related to the purchase of goods is carried out using the contacts specified on the Elstila.lt e-commerce website.
14.2.    Elstila.lt sends all messages in accordance with these Rules, the terms of use of www.elstila.lt, and the Privacy Policy to the Buyer's registered email address or by SMS to the phone number provided during registration or when ordering goods.

15.    Final Provisions

15.1.    These Rules are drawn up in accordance with the laws of the Republic of Lithuania.
15.2.    The relations arising under these Rules are governed by the laws of the Republic of Lithuania.
15.3.    All disputes arising from the implementation of these Rules are resolved through negotiations. In case of failure to reach an agreement within 20 (twenty) calendar days, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
15.4.    In the event that the Buyer disagrees with the response prepared by the Seller and transmitted by Elstila.lt to the Buyer's written claim, the Buyer (natural person, consumer) may submit their request/complaint regarding the goods purchased from Elstila.lt to the State Consumer Rights Protection Authority (Vilniaus g. 25, 01402 Vilnius, email tarnyba@vvtat.lt, tel. 85 262 67 51, fax (85) 279 1466, website www.vvtat.lt (also to the territorial divisions of the State Consumer Rights Protection Authority in the counties) - or fill out the request form on the ODR platform https://ec.europa.eu/odr/.
